Terms of Service

Provider and purpose
The provider is Jochen Schröder (Sektura), Reckenbergstr. 27, 35216 Biedenkopf, Germany; info@sektura.com, alternatively post@jschroeder.net. Orders must serve business, self-employed professional or organisational purposes, not private use. Organisations must identify the actual contracting party and representative authority. An association is not automatically a business or merchant. Actual status, mandatory rights and existing contracts remain decisive; individual agreements prevail.
Services and use
The selected industry SaaS and ordered extras define the services. Authorised users may use them for the agreed purposes. 42 interface languages do not guarantee worldwide legal compliance. No additional uptime or support deadlines are promised here. Agreed functions remain due; updates do not authorise their removal without replacement or new charges. Protect credentials; any third-party account or hardware requirements follow the offer.
Trial and contract
The regular trial is 30 days without a card or automatic payment. Paid use requires a separate order and acceptance; a technical receipt is insufficient. Upgrading does not restart the trial. Paid modules require separate orders; offered 14-day module trials are distinct. Payment start and scope follow the order confirmation.
Prices and payment
The confirmed pricing country, currency, services and monthly or annual total govern. An annual price expressed per month does not mean monthly payment. No VAT is charged on German transactions exempt under §19(1) UStG; cross-border tax treatment follows the specific order. Only offered payment methods apply; returning from a payment dialogue does not confirm payment. New website prices alone do not change existing prices.
Termination and data
You may give notice at any time for the end of the validly agreed term through subscription management or email, without a special written-form requirement. Statutory term limits and termination for cause remain. Separate modules require separate consideration. Notice does not trigger immediate or automatic deletion after 30 days. Agree data return, export, switching and deletion; the DPA and mandatory rights, especially ChapterVI Data Act, remain unaffected. No additional complete-export or restoration guarantee is created.
Privacy and cooperation
Privacy Policy explains processing for our own purposes; it replaces neither consent nor a DPA. Processing on your behalf requires a separate Article 28 GDPR agreement. Customer data remains attributable to the customer and may be used only for lawful agreed purposes. The customer ensures authorised users and lawfully supplied data. The provider retains its security and performance obligations.
Liability
Liability is unlimited for intent, gross negligence, culpable injury to life, body or health, mandatory statutory liability and assumed guarantees. For ordinary negligence affecting essential contractual duties, liability is limited to foreseeable typical contractual loss; otherwise excluded. No blanket exclusion of indirect loss or lost profits overrides this rule. It also applies to representatives and agents; statutory defect rights remain.
Law and versions
German law and statutory jurisdiction apply subject to mandatory rules. There is no blanket choice of court for all customers. The version incorporated and contractual language agreed at conclusion govern. Later website versions do not automatically amend existing contracts.
